NOTICE OF SPECIAL DISTRICT MEETING

TUXEDO UNION FREE SCHOOL DISTRICT

TOWNS OF TUXEDO AND WARWICK

COUNTY OF ORANGE, NEW YORK

NOTICE IS HEREBY GIVEN, that a Special District Meeting of the qualified and registered voters of the Tuxedo Union Free School District of the Towns of Tuxedo and Warwick, Orange County, New York, will be held in the George Grant Mason Elementary School Multipurpose Room in said District on Tuesday, September 22, 2020 between the hours of 2:00 p.m. and 9:00 p.m., prevailing time, at which time the polls will be open to vote by voting machine upon the following proposition:

Shall the Board of Education of the Tuxedo Union Free School District be authorized to enter into a lease-purchase agreement and any financing associated therewith, in accordance with General Municipal Law §109-b, to lease-purchase Four (4) 66- Passenger Buses, Two (2) 66-Passenger Buses with Luggage Compartment, One (1) 34-Passenger Bus, One (1) 30-Passenger Bus,One (1) 24-Passenger Wheelchair Bus, and Three (3) 22-Passenger Buses for a maximum estimated amount of $672,200, at a cost of $168,050 per for four (4) years, commencing in the 2020-2021 school year, and to levy and collect a tax in an amount not to exceed $168,050 per year to meet such obligation, with the purchase option at the end of the lease term in the amount of $261,500.

AND FURTHER NOTICE IS GIVEN, that the qualified and registered voters of the School District shall be entitled to vote at said Special District Meeting. A qualified voter is one who is (1) a citizen of the United States, (2) 18 years of age or older, and (3) a resident within the School District for a period of 30 days immediately preceding the Special District Meeting.

AND FURTHER NOTICE IS GIVEN that personal registration of voters is required pursuant to Section 2014 of the Education Law. If a voter has heretofore registered to vote with the School District and has voted within the last four calendar years, s/he is eligible to vote at this Special District Meeting. If a voter is currently registered to vote with the Orange County Board of Elections, s/he is also eligible to vote. All other persons who wish to vote must register either with the Orange County Board of Elections or with the School District.

Any qualified voter may register to vote for the Special District Meeting at the Office of the District Clerk in the George F. Baker High School, 1 Tornado Drive, Tuxedo, NY, from 9:00 a.m. to 3:00 p.m. on days when school is in session, by providing proof of qualification to vote, until September 17, 2020.

AND FURTHER NOTICE IS GIVEN that the register of voters so prepared shall be filed in the Office of the District Clerk and shall be open for inspection by any qualified voter of the District between the hours of 9 a.m. and 1 p.m., prevailing time, on each of the five days prior to the Special District Meeting, except Saturday and Sunday. Said register will be open for inspection at the polling place on the day of Special District Meeting.

AND FURTHUR NOTICE IS GIVEN that applications for absentee ballots for the Special District Meeting may be obtained on the District website or at the Office of the District Clerk. The application must be received by the District Clerk no earlier than 30 days before and at least seven days before the Special District Meeting if the ballot will be mailed to the voter or the day before the Special District Meeting if the ballot will be picked up personally by the voter or his/her authorized agent named in the application at the District Office. Upon receiving a timely application for a mailed absentee ballot, the District Clerk will mail the ballot to the address designated on the application by no later than six days before the Special District Meeting. Absentee ballots must be received at the Office of the District Clerk by no later than 5:00 P.M., prevailing time, on September 22, 2020.A list of all persons to whom absentee ballots shall have been issued will be available for inspection by qualified voters of the District at the District Clerk’s Office during regular business hours, 9:00 a.m. to 3:00 p.m., prevailing time, until the day of the Special District Meeting. Any qualified voter may file a written challenge of the qualifications of a voter whose name appears on such list, stating the reasons for the challenge.

AND FURTHER NOTICE IS GIVEN NOTICE that Military Voters who are not currently registered to vote may apply to register as a qualified voter of the District by contacting the District Clerk at P. O. Box 2002, Tuxedo, NY 10987; Telephone (845) 351-4799; or email: kdifrancesco@tuxedoufsd.org to receive an application to register as a qualified voter for the Special District Meeting on September 22, 2020.The Military Voter may indicate their preference for receiving the registration application by mail, facsimile or email. The application to register must be received by the District Clerk no later than 5:00 P.M. on August 27, 2020.The register of voters prepared and filed in the District Clerk’s office shall include the names of all military voters who submit a valid military voter registration.

NOTICE IS FURTHER GIVEN that Military Voters who are qualified and registered voters of the District may obtain an application for a military ballot from the District Clerk at P. O. Box 2002, Tuxedo, NY 10987; Telephone (845) 351-4799; or email: kdifrancesco@tuxedoufsd.orgby no later than 5:00 P.M. on August 27, 2020.The Military Voter may indicate their preference for receiving the application for a military ballot by mail, by facsimile or email. Military ballots will be mailed or otherwise distributed no later than 25 days before the Special District Meeting. Military ballots must be received by the District Clerk (1) before the close of the polls on the day of the Special District Meeting and showing a cancellation mark of the U.S postal service or a foreign country’s postal service, or showing a dated endorsement of receipt by another agency of the U.S. government or (2) by 5:00 P.M. on September 22, 2020, and signed and dated by the military voter and one witness thereof, with a date which is ascertained to be not later than the day before the Special District Meeting. A list of all persons to whom military ballots shall have been issued will be available for inspection to qualified voters of the District in the said Office of the District Clerk during regular office hours, 9:00 a.m. to 3:00 p.m., prevailing time, until the day of the Special District Meeting.
