NOTICE IS HEREBY GIVEN, that a Public Hearing of the qualified voters of the Tuxedo Union Free School District, Towns of Tuxedo and Warwick, Orange County, New York, will be held at George Grant Mason Elementary School Multipurpose Room in said district on Wednesday, May 4, 2022 at 7:00 p.m., prevailing time, for the presentation of the 2022-2023 budget.

 

NOTICE IS FURTHER GIVEN, that the Annual Meeting, including Budget Vote and Election, of the qualified and registered voters of the Tuxedo Union Free School District of the Towns of Tuxedo and Warwick, Orange County, New York, will be held in the George Grant Mason Elementary School Multipurpose Room in said District on Tuesday, May 17, 2022 between the hours of 2:00 p.m. and 9:00 p.m., prevailing time, at which time the polls will be open to vote by voting machine upon the following items:

 

1.      To vote on the annual budget of the School District for the fiscal year 2022-2023 and to authorize the requisite portion thereof to be raised by taxation on the taxable property of the District.

2.      To elect three (3) members to the Board of Education for three (3) year terms commencing on July 1, 2022 and terminating on June 30, 2025

3.      To vote on the following proposition:

CAPITAL PROJECT PROPOSITION

Shall the Board of Education of the Tuxedo Union Free School District, Orange County, New York, be authorized to construct alterations and improvements to the District school buildings and sites (“Project”), including, but not limited to, replacing portions of the roofs at the George F. Baker High School (GFB) (flat portion of the original roof) and George Grant Mason School (GGM) (flat and shingle areas) as well as the deteriorated site railings at GGM; including original furnishings, equipment, machinery, apparatus and ancillary or related site and other work required in connection therewith, and preliminary costs incidental thereto, of $2,000,000; and the amount of $2,000,000 shall be transferred from the “Buildings and Facilities Improvements Reserve Fund” to the capital fund for such purposes; provided that the costs of the components of the Project may be reallocated among such components if the Board of Education shall determine that such reallocation is in the best interest of the District.

           

The aforesaid Proposition shall appear on the ballots for the voting machines in substantially the following abbreviated form:

 

Shall the Board of Education of Tuxedo Union Free School District, Orange County, New York (District”), be authorized to construct alterations and improvements to the District school buildings, including to replace portions of the roofs at George F. Baker High School (GFB) and George Grant Mason School (GGM), and replacement of deteriorated site railings at GGM, and to expend therefor, including preliminary costs and costs incidental thereto, an amount not to exceed $2,000,000, and the amount of $2,00,000 shall be transferred from the “Buildings and Facilities Improvements Reserve Fund” for such purposes.

AND FURTHER NOTICE IS GIVEN that petitions nominating candidates for the office of member of the Board of Education shall be filed with the Clerk of said School District at the Superintendent’s Office, George F. Baker High School, Tornado Drive, Tuxedo, New York, not later than Monday, April 18, 2022 by 5:00 p.m.  Each petition shall be directed to the Clerk of the District, shall be signed by at least twenty-five (25) qualified voters of the District and must state the name and residence address of the candidate and the name and residence address of each signer.  Petition forms may be obtained on the district website or at the Superintendent’s Office on weekdays when school is in session during regular business hours.

 

AND FURTHER NOTICE IS GIVEN, that the qualified and registered voters of the School District shall be entitled to vote at said annual vote and election.  A qualified voter is one who is (1) a citizen of the United States, (2) eighteen years of age or older, and (3) a resident within the School District for a period of thirty (30) days immediately preceding the annual vote and election.

 

AND FURTHER NOTICE IS GIVEN that personal registration of voters is required pursuant to Section 2014 of the Education Law.  If a voter has heretofore registered to vote with the School District and has voted within the last four calendar years, s/he is eligible to vote at this annual vote and election.  If a voter is currently registered to vote with the Orange County Board of Elections, s/he is also eligible to vote.  All other persons who wish to vote must register either with the Orange County Board of Elections or with the District. 

 

AND FURTHER NOTICE IS GIVEN that any qualified voter may register to vote for the Annual Budget Vote and School Board Election to be held on May 17, 2022 during regular school business hours, from 8:30 a.m. to 3:30 p.m. on days when the District Offices are open, at the Office of the District Clerk in the George F. Baker High School; 1 Tornado Drive; Tuxedo, NY, through May 12, 2022.

 

AND FURTHER NOTICE IS GIVEN that the register of voters, including the names of military voters who submitted valid military registrations, shall be filed in the Office of the District Clerk and shall be open for inspection by any qualified voter of the District between the hours of 9 a.m. and 1 p.m., prevailing time, on each of the five days prior to the election and vote, except Saturday and Sunday.  Said register will be open for inspection at the polling place on the date of election and vote.

 

AND FURTHUR NOTICE IS GIVEN that applications for absentee ballots for the Annual School District Election and Vote may be at the Office of the District Clerk or on the District website.  The application must be received by the District Clerk no more than thirty (30) days and at least seven (7) days prior to the election if ballot is to be mailed to the voter, or the day before the election if the ballot will be picked up personally by the voter or the voter’s designated agent in the application, at the District Office.  Absentee ballots must be received at the Office of the District Clerk by no later than 5:00 p.m., prevailing time, on the day of the election and vote, May 17, 2022.  A list of all persons to whom absentee ballots have been issued and a list of all military voters to whom military ballots have been issued will be available for inspection to qualified voters of the District, at the Office of the District Clerk during regular office hours, until the day of the election and vote.  Any qualified voter may file a written challenge of the qualifications of a voter, whose name appears on such list, stating the reasons for the challenge.

 

AND FURTHER NOTICE IS GIVEN that military voters who are not currently registered to vote may obtain an application to register as a qualified voter of the District and military voters who are registered to vote in the District may obtain an application for a military ballot, for the Annual Meeting on May 18, 2021by contacting the District Clerk at 1 Tornado Drive, Tuxedo, NY 10987  or email: kdifrancesco@tuxedoufsd.org. The military voter may indicate their preference for receiving the registration application and/or ballot application by mail, facsimile or email.  The completed application to register and/or for a military ballot must be received by the District Clerk no later than 5:00 p.m. on April 21, 2022.  Military ballots will be mailed or otherwise sent no later than 25 days before the election.  Military ballots must be returned by mail or in person and received by the District clerk by 5:00 P.M. on May 17, 2022.

PUBLIC NOTICE - TUXEDO UNION FREE SCHOOL DISTRICT - NOTICE TO ENERGY PERFORMANCE CONTRACTING FIRMS - The Tuxedo Union Free School District is requesting proposals from energy performance contracting firms for the implementation of energy conservation measures on a District-wide basis. Proposals must be received at the District’s Central Administration Office at the address provided herein no later than Thursday, December 16, 2021 11AM.  Late proposals will be returned unopened.  You are invited to submit a proposal in accordance with the requirements of the District’s Request for Proposals for Energy Performance Contracting Services.  The District’s Request for Proposals may be obtained from the District’s Central Administration Office located at 1 Tornado Drive, Tuxedo, New York 10987, or via jwhite@tuxedoufsd.org commencing on Monday, December 6, 2021, between the hours of 9:00 AM and 4:00 PM.  To prevent opening by unauthorized individuals, the proposal should be identified on the envelope or other wrapper as “Proposal, Energy Performance Contracting Services for the Tuxedo Union Free School District”.  Proposals may be mailed, or hand delivered.  No proposal will be accepted by electronic mail or facsimile transmission.  All proposals should be addressed to Mr. Jeff White, Superintendent of Schools, Tuxedo Union Free School District, 1 Tornado Drive, Tuxedo, New York 10987.  The District reserves the right to amend its RFP for any reason and participating Energy Performance Contractors will receive all such amendments in writing.  The RFP does not obligate the District to award a contract, pay any cost incurred in the preparation of a proposal in response to the RFP, or to procure or contract for services.  The District intends to award a contract on the basis of the best interest and advantage to the District and reserves the right to accept or reject any or all proposals received as a result of the RFP, to negotiate with all qualified Proposers/Respondents (hereinafter referred to interchangeably as “Proposer” and/or “Respondent”), or to cancel the RFP in part or in its entirety, if it is in the best interest of the District to do so.  No Proposer shall have any legal, equitable, or contractual rights of any kind arising out of its submission of a proposal.

 The Board of Education of the Tuxedo Union Free School District, Tuxedo Park, County of Orange, New York, in accordance with Section 103 of Article 5-A of the General Municipal Law, hereby requests the submission of requests for Transportation Services.

 Detailed Bid Specifications, Conditions, and forms for Bid submissions are available on the School District’s website at www.tuxedoschooldistrict.org beginning December 8, 2020. 

 Bids will be received until 10:30 a.m. on December 15, 2020, by Kevin Ziemba, School Business Official, at the Tuxedo Union Free School District Business Office located at 1 Tornado Drive, Tuxedo Park, New York, at which time all Bids will be opened and read aloud via Webex video conferencing.  Bids will not be accepted that are sent by facsimile or by electronic mail.  Any bids received after this deadline will be returned unopened to the firm. 

 A pre-Bid meeting will be held on December 8, 2020 at 10:30 AM local time via Webex video conferencing.

 The Board of Education of the Tuxedo Union Free School District reserves the right to waive, or refuse to waive, informalities in bidding or accept or reject any and all bids, as it determines to be in the best interest of the School District.

Shall the Board of Education of the Tuxedo Union Free School District be authorized to enter into a lease-purchase agreement and any financing associated therewith, in accordance with General Municipal Law §109-b, to lease-purchase Four (4) 66- Passenger Buses, Two (2) 66-Passenger Buses with Luggage Compartment, One (1) 34-Passenger Bus, One (1) 30-Passenger Bus,One (1) 24-Passenger Wheelchair Bus, and Three (3) 22-Passenger Buses for a maximum estimated amount of $672,200, at a cost of $168,050 per for four (4) years, commencing in the 2020-2021 school year, and to levy and collect a tax in an amount not to exceed $168,050 per year to meet such obligation, with the purchase option at the end of the lease term in the amount of $261,500.

A qualified voter is one who is (1) a citizen of the United States, (2) 18 years of age or older, and (3) a resident within the School District for a period of 30 days immediately preceding the Special District Meeting.

BOND PROPOSITION

RESOLVED:

(a)That the Board of Education of the Tuxedo Union Free School District, in the County of Orange, New York (the “District”), is hereby authorized to construct alterations and improvements to District buildings and sites (the “Project”) substantially as described in a report prepared for the District by Clark Patterson Lee, Architects (the “Report”), which report is on file and available for public inspection at the office of the District Clerk, including (as and where necessary): exterior building improvements, including roof restoration, brick repointing, parapet rehabilitation and gymnasium façade improvements; the construction of a new Pre-K playground and security vestibules; ADA improvements; replacement of doors, windows and ceilings; improvements to the heating, ventilation, air conditioning, drainage and water treatment systems; parking, walkway, wing wall and railing enhancements; bathroom renovation and the acquisition and installation of CO2 detectors; all of the foregoing to include the furnishings, equipment, machinery, apparatus and ancillary or related site, demolition and other work required in connection therewith; and to expend therefor, including preliminary costs and costs incidental thereto and to the financing thereof, an amount not to exceed the estimated maximum cost of $4,236,194; provided that the costs of the components of the Project as set forth in the Report may be reallocated among such components if the Board of Education shall determine that such reallocation is in the best interests of the District;

(b)that $1,236,194 of District funds on hand are hereby authorized to be expended to pay a portion of the cost of the Project, and such expenditure is hereby approved;

(c)that a tax is hereby voted in the amount of not to exceed $3,000,000to finance the balance of the cost of the Project, such tax to be levied and collected in installments in such years and in such amounts as shall be determined by said Board of Education; and in anticipation of said tax, bonds are authorized in the principal amount of not to exceed $3,000,000and a tax is hereby voted to pay the interest on said bonds as the same shall become due and payable; and

(d)that $250,000 of capital reserve funds, plus any interest earnings thereon, are on hand and available in the “Buildings and Facilities Improvement Reserve Fund,” approved by the voters of the District on May 15, 2018, and the expenditure thereof to pay a portion of the cost of the Project is hereby approved; provided any amount of such capital reserve funds so expended shall offset and reduce by like amount the bonds and taxes herein authorized.

Such Bond Proposition shall appear on the ballots used for voting at said Special District Meeting in substantially the following condensed form:

RESOLVED:

(a) That the Board of Education of the Tuxedo Union Free School District, in the County of Orange, New York (the “District”), is hereby authorized to construct alterations and improvements to District buildings and sites, and to expend therefor an amount not to exceed $4,236,194; (b)that $1,236,194 of District funds on hand are hereby authorized to be expended to pay a portion of the cost thereof, and such expenditure is hereby approved; (c)that a tax is hereby voted in the amount of not to exceed $3,000,000to finance the balance of said cost, such tax to be levied and collected in installments in such years and in such amounts as shall be determined by said Board of Education; and in anticipation of said tax, bonds are authorized in the principal amount of not to exceed $3,000,000and a tax is hereby voted to pay the interest on said bonds as the same shall become due and payable; and (d) that $250,000 of capital reserve funds, plus any interest earnings thereon, are on hand and available in the “Buildings and Facilities Improvement Reserve Fund,” approved by the voters of the District on May 15, 2018, and the expenditure thereof to pay a portion of said cost is hereby approved; provided any amount of such capital reserve funds so expended shall offset and reduce by like amount the bonds and taxes herein authorized.

The voting will be conducted by ballot on voting machines or paper ballot as provided in the Education Law and the polls will remain open from 2:00 o’clock P.M. to 9:00 o’clock P.M. (Prevailing Time) and as much longer as may be necessary to enable the voters then present to cast their ballots.

NOTICE IS HEREBY FURTHER GIVEN that, pursuant to Section 2014 of the Education Law, personal registration of voters is required for said Special District Meeting, and no person shall be entitled to vote at the Special District Meeting to be held as aforesaid, whose name does not appear on the register of the School District. Walk-in registration of the qualified voters of the District for said Special District Meeting will be held between 8:30 o’clock A.M. and 3:30 o’clock P.M. (Prevailing Time) on days when the District Offices are open, at the Office of the District Clerk until February 20, 2020, for the purpose of preparing the register of the School District for the Special District Meeting to be held on February 25, 2020, at which time any person shall be entitled to have his/her name placed upon such register if he or she is known or proven to be then or thereafter entitled to vote. The register of the qualified voters of said District prepared for the Annual District Meeting and Election held on May 21, 2019 shall be used as the basis for the preparation of the register for said Special District Meeting to be held on February 25, 2020. Any person whose name appears on such register or who shall have been previously registered for any annual or special district meeting or election and who shall have voted at any annual or special district meeting or election held or conducted at any time since January 1, 2016, will not be required to register personally for this Special District Meeting.In addition, any person otherwise qualified to vote who is registered with the Board of Elections of Orange County under the provisions of the Election Law shall be entitled to vote at said Special District Meeting without further registration.

AND FURTHER NOTICE IS GIVEN that the register of voters so prepared shall be filed in the Office of the District Clerk and shall be open for inspection by any qualified voter of the District between the hours of 9:00 o’clock A.M. and 1:00 o’clock P.M. (Prevailing Time) on each of the five days prior to the vote, except Sunday, February 23, 2020, and by advance appointment only on Saturday, February 22, 2020. Said register will be open for inspection at the polling place on the date of the vote.

FURTHUR NOTICE IS GIVEN that applications for absentee ballots may be obtained at the office of the District Clerk during school business hours. Completed applications must be received by the District Clerk at least seven (7) days before the date of the Special District Meeting if the ballot is to be mailed to the voter, or the day before the Special District Meeting if the ballot is to be delivered personally to the voter.No absentee voter's ballot shall be canvassed unless it shall have been received in the office of the District Clerk not later than 5:00 o’clock P.M. (Prevailing Time) on the day of the vote. A list of all persons to whom absentee ballots shall have been issued will be available in the office of the District Clerk during regular business hours until the date set for the Special District Meeting. Any qualified voter may file a written challenge of the qualifications of a voter, whose name appears on such list, stating the reasons for the challenge.
