NOTICE IS HEREBY GIVEN that the Board of Education of the Tuxedo Union Free School District shall hold a public hearing on the 20th day of February, 2020, at 7 P.M., at the George F. Baker Upper School, Community Room 104, 1 Tornado Drive, Tuxedo, New York, for the purpose of discussion of increasing the maximum eligibility limits for (1) the senior citizens partial real property tax exemption pursuant to §467 of the Real Property Tax Law and (2) the individuals with disabilities partial real property tax exemption pursuant to §459-c of the Real Property Tax Law, effective for assessment rolls prepared on the basis of the taxable status dates occurring on or after January 1, 2020.

NOTICE OF SPECIAL DISTRICT MEETING

TUXEDO UNION FREE SCHOOL DISTRICT,

IN THE COUNTY OF ORANGE, NEW YORK

NOTICE IS HEREBY GIVEN that pursuant to a resolution of the Board of Education of the Tuxedo Union Free School District, in the County of Orange, New York, adopted on December 12, 2019, a Special District Meeting of the qualified voters of said School District will be held on

TUESDAY, FEBRUARY 25, 2020

from 2:00 o’clock P.M. to 9:00 o’clock P.M. (Prevailing Time) at the George Grant Mason Elementary School Multipurpose Room, in said District, for the purpose of voting upon the following Bond Proposition:

BOND PROPOSITION

RESOLVED:

(a)That the Board of Education of the Tuxedo Union Free School District, in the County of Orange, New York (the “District”), is hereby authorized to construct alterations and improvements to District buildings and sites (the “Project”) substantially as described in a report prepared for the District by Clark Patterson Lee, Architects (the “Report”), which report is on file and available for public inspection at the office of the District Clerk, including (as and where necessary): exterior building improvements, including roof restoration, brick repointing, parapet rehabilitation and gymnasium façade improvements; the construction of a new Pre-K playground and security vestibules; ADA improvements; replacement of doors, windows and ceilings; improvements to the heating, ventilation, air conditioning, drainage and water treatment systems; parking, walkway, wing wall and railing enhancements; bathroom renovation and the acquisition and installation of CO2 detectors; all of the foregoing to include the furnishings, equipment, machinery, apparatus and ancillary or related site, demolition and other work required in connection therewith; and to expend therefor, including preliminary costs and costs incidental thereto and to the financing thereof, an amount not to exceed the estimated maximum cost of $4,236,194; provided that the costs of the components of the Project as set forth in the Report may be reallocated among such components if the Board of Education shall determine that such reallocation is in the best interests of the District;

(b)that $1,236,194 of District funds on hand are hereby authorized to be expended to pay a portion of the cost of the Project, and such expenditure is hereby approved;

(c)that a tax is hereby voted in the amount of not to exceed $3,000,000to finance the balance of the cost of the Project, such tax to be levied and collected in installments in such years and in such amounts as shall be determined by said Board of Education; and in anticipation of said tax, bonds are authorized in the principal amount of not to exceed $3,000,000and a tax is hereby voted to pay the interest on said bonds as the same shall become due and payable; and

(d)that $250,000 of capital reserve funds, plus any interest earnings thereon, are on hand and available in the “Buildings and Facilities Improvement Reserve Fund,” approved by the voters of the District on May 15, 2018, and the expenditure thereof to pay a portion of the cost of the Project is hereby approved; provided any amount of such capital reserve funds so expended shall offset and reduce by like amount the bonds and taxes herein authorized.

Such Bond Proposition shall appear on the ballots used for voting at said Special District Meeting in substantially the following condensed form:

(a) That the Board of Education of the Tuxedo Union Free School District, in the County of Orange, New York (the “District”), is hereby authorized to construct alterations and improvements to District buildings and sites, and to expend therefor an amount not to exceed $4,236,194; (b)that $1,236,194 of District funds on hand are hereby authorized to be expended to pay a portion of the cost thereof, and such expenditure is hereby approved; (c)that a tax is hereby voted in the amount of not to exceed $3,000,000to finance the balance of said cost, such tax to be levied and collected in installments in such years and in such amounts as shall be determined by said Board of Education; and in anticipation of said tax, bonds are authorized in the principal amount of not to exceed $3,000,000and a tax is hereby voted to pay the interest on said bonds as the same shall become due and payable; and (d) that $250,000 of capital reserve funds, plus any interest earnings thereon, are on hand and available in the “Buildings and Facilities Improvement Reserve Fund,” approved by the voters of the District on May 15, 2018, and the expenditure thereof to pay a portion of said cost is hereby approved; provided any amount of such capital reserve funds so expended shall offset and reduce by like amount the bonds and taxes herein authorized.

The voting will be conducted by ballot on voting machines or paper ballot as provided in the Education Law and the polls will remain open from 2:00 o’clock P.M. to 9:00 o’clock P.M. (Prevailing Time) and as much longer as may be necessary to enable the voters then present to cast their ballots.

NOTICE IS HEREBY FURTHER GIVEN that, pursuant to Section 2014 of the Education Law, personal registration of voters is required for said Special District Meeting, and no person shall be entitled to vote at the Special District Meeting to be held as aforesaid, whose name does not appear on the register of the School District. Walk-in registration of the qualified voters of the District for said Special District Meeting will be held between 8:30 o’clock A.M. and 3:30 o’clock P.M. (Prevailing Time) on days when the District Offices are open, at the Office of the District Clerk until February 20, 2020, for the purpose of preparing the register of the School District for the Special District Meeting to be held on February 25, 2020, at which time any person shall be entitled to have his/her name placed upon such register if he or she is known or proven to be then or thereafter entitled to vote. The register of the qualified voters of said District prepared for the Annual District Meeting and Election held on May 21, 2019 shall be used as the basis for the preparation of the register for said Special District Meeting to be held on February 25, 2020. Any person whose name appears on such register or who shall have been previously registered for any annual or special district meeting or election and who shall have voted at any annual or special district meeting or election held or conducted at any time since January 1, 2016, will not be required to register personally for this Special District Meeting.In addition, any person otherwise qualified to vote who is registered with the Board of Elections of Orange County under the provisions of the Election Law shall be entitled to vote at said Special District Meeting without further registration.

AND FURTHER NOTICE IS GIVEN that the register of voters so prepared shall be filed in the Office of the District Clerk and shall be open for inspection by any qualified voter of the District between the hours of 9:00 o’clock A.M. and 1:00 o’clock P.M. (Prevailing Time) on each of the five days prior to the vote, except Sunday, February 23, 2020, and by advance appointment only on Saturday, February 22, 2020. Said register will be open for inspection at the polling place on the date of the vote.

FURTHUR NOTICE IS GIVEN that applications for absentee ballots may be obtained at the office of the District Clerk during school business hours. Completed applications must be received by the District Clerk at least seven (7) days before the date of the Special District Meeting if the ballot is to be mailed to the voter, or the day before the Special District Meeting if the ballot is to be delivered personally to the voter.No absentee voter's ballot shall be canvassed unless it shall have been received in the office of the District Clerk not later than 5:00 o’clock P.M. (Prevailing Time) on the day of the vote. A list of all persons to whom absentee ballots shall have been issued will be available in the office of the District Clerk during regular business hours until the date set for the Special District Meeting. Any qualified voter may file a written challenge of the qualifications of a voter, whose name appears on such list, stating the reasons for the challenge.
